Terms of Service

1. Estimates

The estimate becomes contractually binding once:

• It is signed by the client and returned by post or email;
• Or there is written communication, via post or email, confirming the assignment.

2. Related Rights

Performers’ rights are enshrined in Portuguese law since 1985, through the Code of Copyright and Related Rights (CDADC). These are rights related to copyright, granted to artists in light of the use of their performances. Thus:

• 2.1 The economic rights of any pieces or works produced are owned by the client.
• 2.2 The moral and intellectual rights of any creative work, including code, are owned by the agency (BYDAS – Digital Communication Agency, Lda.).

3. Assignment

• 3.1 The service is considered assigned upon receipt of payment or its proof by BYDAS.
• 3.2 Execution begins on the first business day following confirmation of assignment.
• 3.3 For services involving media investment (e.g., online ads), full payment is required upon assignment.
• 3.4 For ongoing marketing/management services, payment is due monthly in advance without formal assignment.

4. Revisions

• 4.1 Once development services are completed, the client must proceed with their review.
• 4.2 The review serves to identify graphical, spelling or functional errors. It is not intended for content or feature changes.
• 4.3 The revision must be returned within 5 business days, unless otherwise agreed in writing.
• 4.4 Once the instructions are received, the agency will implement the corrections and consider the service concluded.
• 4.5 Any additional changes after this phase will be invoiced separately.
• 4.6 Consultancy and marketing services do not include a revision phase.

5. Service Completion

• 5.1 Considered complete once corrections from the revision have been implemented.
• 5.2 An invoice is issued upon completion, and payment must be made for publication to occur.
• 5.3 Publication is only carried out after payment is confirmed.

6. After-Sales

• 6.1 Interactive services include one month of free technical support. Graphic services do not include support.
• 6.2 After that, the hourly rate applies, unless a support plan has been contracted.
• 6.3 Termination of a plan implies deletion of project data from the agency’s servers.

7. Warranties – Interactive Pieces

• 7.1 One-month warranty for content or code corrections.
• 7.2 Code complies with W3C standards.
• 7.3 The technology is open, allowing qualified third-party management.
• 7.4 Compatibility is guaranteed for up to two previous browser versions.
• 7.5 Compatibility is not guaranteed in case of external technological changes.
• 7.6 Shopify technology is managed by its platform; the agency only configures it.

8. Warranties – Graphic Pieces

• 8.1 In case of a proven error by the agency, the client is entitled to reimbursement if claimed within 30 days of delivery.
• 8.2 Errors caused by the client's choices are not eligible for reimbursement.
• 8.3 Source files are kept for 12 months (occasional clients) or 36 months (retainer clients).
• 8.4 Requesting source files after 30 days incurs a 100€+VAT service fee.

9. Warranties – Management and Consultancy

• 9.1 Services are provided ethically and professionally; the client may request cancellation if misconduct is proven.
• 9.2 Data used in reports is from official sources like Google or Meta.
• 9.3 The agency does not guarantee specific SEO rankings due to the confidential nature of Google's algorithm.
• 9.4 SEO results depend on the stability of Google’s algorithm.

10. Pricing Policy

• 10.1 The agency may update its prices, respecting active contracts.
• 10.2 Annual updates are based on the inflation rate published by INE (Portugal's Statistics Office).

Reference Pricing

• 55.00€/hour + VAT: regular services
• 79.50€/hour + VAT: urgent or non-client services
• Hour packs: minimum of 8 hours

Domains

Includes DNS setup, cloud email, and technical configuration.

Hosting Plans

Includes domain linking, email setup, and anti-spam filtering. For cloud solutions, request a quote.
